[1] These two cases are a warning story for the RAF and for those who rely on it – they are all South Africans and especially those who are made vulnerable and suffer a lot from car accidents. This decision deals with the scope of the courts in circumstances where the parties acted jointly to settle a trial in questionable circumstances and attempt to avoid judicial review of the settlement. [46] This application was made after the Vice-President of the Court refused to make the settlement agreement a court order. and to order that the process continue, even though the settlement agreement has been reached by the parties.
